The jury trial over a fatal Beloit shooting from 2019 is being pushed back to December.

Anthony Sims and Gregory Carter of Beloit were scheduled to go on trial July 13, but the Rock County Court system isn’t ready to safely handle an in-person jury due to the COVID-19 pandemic.

The two men are each charged with party to the crime of first-degree recklessly endangering safety for their roles in a triple shooting that killed 21-year-old Treron White in March of 2019.

The criminal complaint does not identify which shooter caused the death, which could be why neither man is charged with homicide.

Both men were released without charges after their initial arrest, but Rock County District Attorney David O’Leary filed charges against them this past February following a complex investigation by Beloit police.

Defense attorney Jeff Purnell said in court Tuesday that Carter has since been diagnosed with cancer. He posted a $25,000 cash bond and travels to the UW hospital in Madison for treatment while on an electronic monitoring bracelet.

Sims remains in custody in the Rock County jail on a $100,000 cash bond.

Judge Barbara McCrory denied Purnell’s severance motion to split the two defendants into separate cases because of how closely connected their alleged actions were.

Their new trial is set for the week of December 7.
